NSI was responsible for domain name registration services. The monopoly on registration
was held by NSI until September 2000. In its place, a shared registry system (SRS) was
developed and phased-in and which ofŽ cially started in April 1999. Until 2000, NSI also
administered all of the gTLDs except .mil which was regulated by the US Department of
Defence.
Until recently, the Internet Assigned Numbers Authority (IANA) was the central coordinator
for the assignment of unique parameter values, that is, the domain names and their
IP addresses. In 1998, the Internet Corporation for Assigned Names and Numbers
(ICANN),1 a non proŽ t organization, was formed for the purpose of taking over the
Internet and Trademark Law 201
domain name assignment function as well as the IP address allocation function and the
general of the domain name system including root and name serverIn effect, ICANN took over many of the functions of Internic. It established the SRS
system and controlled all internet registry and registrar functions.
Given the fanfare and attention that internet domain names system has received to date,
it would be quite unthinkable that the system would be allowed to be dismantled, even
though technically , the function and operation of the internet does not require its existence.
As one commentator has noted,2 if the whole domain name system were to be removed and
we all use IP addresses when we send emails and access web pages rather than domain
names, that would solve all the problems. The idea may seem draconian but that is in fact
how we have been using the telephone system for many years. If we want to call Jane
